Employers
Employers and Recruiters (‘Clients') must register as a member to use the Employgo.co.uk service. Membership commences the moment registrations is completed via the website, and continues until such point that it is terminated either by the client or Employgo LLP
Job Advertising
By submitting a vacancy, the Client is authorising Employgo LLP to post such vacancy. The Client is responsible for the content of the vacancy and will indemnify Employgo LLP against any claim, loss, liability, expense and/or damage ("Losses") in connection therewith.
The Client shall provide sufficient details about itself and the vacancy to Applicants including without limitation all the fields required to be filled in on the registration form, no job may be posted with fields incomplete. The client must state the salary as £ per hour, and this figure should be adhered to in any following agreements between the client and Job Seeker. It is the Client's responsibility to protect their computers against any viruses.
The Client shall not post any vacancy that directly or indirectly promotes age, sex, race or disability discrimination. The Client will indemnify Employgo LLP against any Losses in connection therewith. If we believe that an advert may be discriminatory, we may at our discretion either amend the advertisement or remove it from Employgo.co.uk without liability to you and will inform you accordingly.
Responses to job vacancies
Employgo LLP does not guarantee that the Client will receive any responses to its displayed job vacancies. The Client is responsible for verifying the information contained in Applicants' responses and Employgo LLP accepts no responsibility for the content of any such application. In particular, but without limitation, the Client is responsible for verifying the Applicant's identity, eligibility to work, experience, training, qualifications and authorisations required by the Client, by law or by any relevant professional body for the vacancy. You agree to deal fairly and professionally with individuals who may respond to an advertisement you have posted and not do anything which may bring Employgo LLP into disrepute. All and any subsequent dealings between the Client and any Applicant and in connection with the Applicant's response to the vacancy are the responsibility of the Client and Employgo LLP accepts no liability whatsoever therewith.
The Client will indemnify Employgo LLP against any Losses in connection therewith.
The Client will comply with the provisions of the Data Protection Act 1998 in relation to all Applicants' details and indemnify Employgo LLP against any Losses in connection therewith. The Client accepts responsibility for any detriment which it may suffer or incur in respect of the engagement of an Applicant and shall hold Employgo LLP harmless against any Losses in connection therewith. The Client shall use all reasonable endeavours to ascertain that it will not be detrimental to the interests of the Applicant it intends to engage (if any) to work for the Client in the vacancy posted.
Employment agencies and employment businesses
Where the Client is an employment agency or employment business, it must state in which capacity it is acting in relation to the vacancy.
The Client, if an employment agency or an employment business as defined in the Conduct of Employment Agencies and Businesses Regulations 2003 ("the Regulations"), will comply with the provisions of the Regulations and the Employment Agencies Act 1973 in relation to all vacancies posted on Employgo.co.uk. communications with Applicants and management of Applicants' details and indemnify Employgo LLP against any Losses in connection therewith. Employgo LLP monitors the quality of vacancies from time to time in order to provide a better service to candidates.
Site rules
We have rules regarding the content and format of jobs posted on Employgo.co.uk. Their purpose is to ensure that users who search the database get results which are presented as clearly and informatively as possible. You agree that we may, at our discretion and without liability to you, remove from Employgo.co.uk any job advertisement which is posted in breach of these rules. The rules may change from time to time and you are advised to refer to them regularly.
The Rules are:
- No duplicating of jobs at the expense of other clients' jobs.
- No gratuitous use of keywords in job descriptions or job titles. Gratuitous means deliberately inserting words, strings of words, or repeating job titles, with the intention of influencing position in the results listing, or increasing the number of page views.
- Job advertisements placed on Employgo.co.uk must be for genuine vacancies only, and not for other products or services, either relating to or unrelated to recruitment including, but not limited to, affiliate schemes, pyramid selling schemes or any other so called 'business opportunity'. Any breaches of this rule will be taken very seriously.
- URLs or email links (live or text only) are not permitted in the body copy of the job description page. These can be purchased as extras for a fee.
Third party sites
Vacancies you post on Employgo.co.uk may also appear on third party recruitment web sites pursuant to agreements from time to time between Employgo LLP and the proprietors of such web sites.
Use of candidate database
Employment agencies and employment businesses If you are an employment agency or an employment business (as defined by the Employment Agencies Act 1973 ('the Act')) it is your responsibility to ensure that the use you make of information from our candidate database complies with your obligations under the Act and the various regulations made under it, together with any applicable guidelines. These regulations are currently contained in the Conduct of Employment Agencies and Employment Businesses Regulations 2004. You agree to comply with the Act and these regulations as they affect the conduct of your business and the use you make of information on our candidate database.
Rights in the database
Database rights and all other applicable copyright and intellectual property rights in the candidate database belong to Employgo LLP. You acknowledge that you do not acquire any rights in the database or its content and that your retention and use of the database and its content is governed by these terms and conditions.
Use of the database
Clients may
- Use the candidate database for the purpose of finding suitable candidates for specific job vacancies that you or (if you are an employment agency or employment business) your client wish to fill.
- Use the information about the individuals contained in the database for the purpose of contacting them in relation to a specific job vacancy.
- Use the information only in connection with your own recruitment-related activities.
You may NOT:
- Supply, sell or license material from the candidate database, or a copy of it, to any other person, including another member of your group of companies.
- Download the database through any automated (e.g. "scraping") process.
- Contact the individuals on the database or make or allow any use of the information about those individuals, other than for the purpose of finding suitable candidates for specific job vacancies. You must, at all times, comply with the Data Protection Act 1998 and all subsequent legislation and regulations.
Deletion of database material
You agree to delete all material from the candidate database upon its replacement with up-to-date material or the satisfactory conclusion of your search for a suitable candidate, whichever occurs first.
Dealings with candidates
You agree to deal fairly and professionally with individuals you may contact using information from the candidate database and not do anything which may bring Employgo LLP into disrepute. You will indemnify Employgo LLP from and against any claim brought by an individual against Employgo LLP arising from your breach of this obligation or any other of these terms and conditions.
Passwords
Passwords are for the sole use of the person to whom they are issued. We may deny access to a password if we reasonably believe that it is being used by an unauthorised person or that the user is breaching these terms.
Termination
We may terminate the provision of membership services if:
- The client is in material breach of these terms and conditions and has not remedied such breach within ten days of notice specifying the breach and requiring that it be remedied, or:
- The client becomes insolvent, ceases to trade or goes into liquidation or:
- The client has failed to submit payments within the agreed timescales
- The client has not provided full or accurate contact or company information
- The client uses Employgo.co.uk to advertise websites, services, businesses and/or business opportunities in any part of the job vacancy or on any part of the site.
By accessing or using any part, service or feature of this site, the Client agrees to use it in 'good faith' i.e. to post authentic, impartial and unique jobs of reasonable quality, which provide both adequate and accurate job details. The Client also agrees that any abuse of the service, website or these terms and conditions can result in the Client's access to this service being removed, and accounts terminated.
Changes to Terms and Conditions and Invalidity
These website terms and conditions may be changed by us at any time. You will be deemed to accept the terms and conditions (as amended) when you next use this site following any amendment.
If any provision of these terms and conditions is held to be invalid by a court of competent jurisdiction, such invalidity shall not affect the validity of the remaining provisions, which shall remain in full force and effect.
Force Majeure
We shall not be liable to you in respect of anything that constitutes breach of these Terms and Conditions arising by reason of force majeure, namely circumstances beyond our control which shall include, but shall not be limited to, acts of God, perils of the sea or air, fire, flood, drought, explosion, sabotage, accident, embargo, telecommunications and utilities failure, riot, civil commotion or civil authority, including acts of local government and parliamentary authority, breakdown of plant and machinery or software or death of royalty.
Governing law
These terms and conditions shall be interpreted in accordance with English law and all disputes shall be decided by the English courts.
